VDOT Right-of-Way

This is the year (2012) that VDOT will be accepting the Richland Forest roads as state roads. VDOT will then be responsible for road maintenance and snow removal. Up to now, Centex has been on the hook for this.

As part of the turnover process, VDOT will be making sure that the right-of-way is clear of obstructions. The right-of-way extends 10″ into your property from the back edge of the sidewalk or, for houses with no sidewalk in front, 6″ further into your property from the top of your driveway apron. (The apron is that concrete portion that meets the asphalt of your driveway.)

Recently, we rode around Richland Forest with a Centex representative and he pointed out to us some of the things in the right-of-way that will have to be removed, either by the homeowner or by Centex, before VDOT acceptance. Included here are some examples. This is not a comprehensive gallery of issues; it is simply meant to show you the kind of things that have to be addressed. You can take measures to clear your own right-of-way area or Centex (or ultimately VDOT) will do it.

Some people will undoubtedly be angry about things being removed. Please keep in mind: we are only the messenger. This is not a decision or action taken by your HOA; it is a requirement of VDOT. If you have any questions, we will be glad to try to answer them, but the ultimate authority for any appeal is VDOT.
